Folks - here’s the latest on this. I emailed Mr. Gervais (he’d sent me an email thanking me for my original blog post) with:

Dear Christopher,
You might want to check on the responses to my blog entry about your magazine – there are some people who do not feel they have been dealt with fairly.

Since I’m a businessperson myself, I always like to make sure that I know how my clients and colleagues feel – and I like to do everything in my power to make things right, if there’s an issue.

This was his response:

Dear Julie:

I have not spoken to any of these people that have written on your blog. So the fact is not one has called and engaged in a conversation to me or my “Interns” since I have no intern. No such person called on Monday by the name of Lori Lemanski.

I will remind that you are legally responsible for any information that is posted on your website (as you are the owner) that is false. I have enough attorneys to consult on this matter. I will not permit false and misleading information to be spread about the magazine.

If your groupies want to be critical, do so to the former Wildlife Art that took everyone money when the ceased operations.

    I think that the Sunshine Artist forum tells us everything we need to know. Gervais seems to have a long track record of “problems” with his art shows. I know this type. He will keep going until he is stopped because he has no boundaries, IMHO.

    He’s canny, though. Called Lori a liar without ever saying the word.

    The above has all the appearances of “legalese” and with that in mind, I would simply point out that, technically at least, “speaking to” and “contacting” are not necessarily the same thing.

    Of course, none of us has any evidence for the veracity of Anjie Cook’s statement on that other post (”I actually contacted him 2 weeks prior…”), but I would have to say that it is at least possible that this refers to contact by email, for example.

    It is also possible that Mr. Gervais has a secretary or other person who is NOT an intern who deals with correspondence. In fact, it is at least possible that Mr. Gervais is not personally aware of said contact (if I may be permitted to make use of said legalese myself).

    Which, of course, would mean that BOTH Cook’s and Gervais’ statements are true (at least in a strictly legal sense)

    One final observation: the confrontational tone of the above response from Mr Gervais strikes me as a bit odd. The only case where it might seem warranted (at least to me) is the case in which Anjie Cook (assuming that is her real name) had simply “made up” the part about being owed $300 and what earthly reason could she have for doing that and risking a legal suit?
    None that I can see. But what do I know? I’m just one of “Julie’s Groupies” (TM).

    LOL at the “AJG” and related terms! I found Mr. Gervais’ “groupie” comment bemusing, since many of the folks who post on my blog are not people I’ve ever met or personally know. Such is the power of the web.

    I also found the tone of his email a bit odd; if someone let me know that there were folks who had done business with me and who were unhappy, I’d want to follow up with the unhappy parties and see where things went awry, and how to fix the situation…not threaten the bearer of the news with legal action.

    By the by, in an interesting coincidence, I got an hand-addressed envelope today from,would you believe, Wildlife Art Shows containing two black and white xeroxed pages of cheap copy paper (thinking about what SEWE sends out):

    One for the Rocky Mountain (only one?) Western and Wildlife Art Show, to be held in October in Loveland, Colorado, Larimer County Fairgrounds. Featured artists: Robert Deurloo, sculptor and Joe Kronenberg, painter. $350 for a 10×10 booth 10×20 $650.

    And the second for 2nd Annual Grand Teton Western Art and Wildlife Show, to be held in September at the Snow King Center, Jackson, Wyoming; featured artists, Brent Flory, painter and Peggy Detmers, sculptor; 10×10 booth $500 10×20 $950.

    Make of this information what you will.

    **(Thanks for the phrase, Christopher, though I would just caution that you can’t trademark it since you just said “your groupies”, which, being a common phrase is not trademarkable (if that’s a word) . As should be a clear to anyone who reads the above, it was was I who actually put “Julie’s” and “Groupies” together so it is I who can get the trademark on “Julie’s Groupies” if I so choose (and you better believe it, I will fight tooth and nail for it in court). And lest you think “Julie Groupie” is still open for tradmark, think again. Susan has dibs on that one (so there).

    I posted a response to an earlier entry, but will post again here. Having worked in the legal profession for 44 years, his inate threats of legal action do not impress me. As I am sure many of you know, another promoter was sentenced to 51 months in jail, 3 years probation and restitution for doing exactly the same thing. I too have received empty promises of refunds that never come. He seems to think that by refusing the certified mail he can feign ignorance and hold me to the contract, which is obvious, because he listed my name on the Grand Teton show three days AFTER he was advised of the cancellation by certified mail and first class mail. What he doesn’t understand is that he does not have to accept it; the cancellation is effective upon my SENDING it. I too, have written, emailed, called and received no response to my requests and demands for refunds. I was to be in the Tucson show; and finally, after several requests for information, received an email that he didn’t have enough exhibitors and had to “postpone” the show. I am still “obligated” for Kansas City, but like all the shows since Jan 09, it too will be cancelled. He will then owe me $750.00.

    Just some clarification…I tried to call twice on Monday…just got voice mail, so I left no message. Hense, ‘no call on Monday form Lori Lemanski’. Mr. Gervais says he has no intern, huh? Well, the man that I talked to said he was an intern PLUS he said his name was ‘Troy’…could this be the Troy Marsh that others mentioned? Was it Mr. Gervais himself orginally that called me and harrassed me?? I mean, all I wanted was a subscription……and to be asked if i was ‘too good to use the internet’ was uncalled for, as was the threat of being sued. This is all nuts.

    I grew up in the 50’s when a man’s word and a handshake were all you needed to know you would get a fair deal. Today, sadly, integrity and moral values are too often replaced by greed and the desire to make a quick buck (at the expense of others). I take consolation in the fact that eventually, the greed will do them in, and those of us that maintain our integrity and values will ultimately end up the winners. It has always been that way….

I’m very thankful that all these things have been posted here - the internet brings sunshine to dark corners - and am hopeful that no other artist will have to suffer what you have. I wonder if there’s some way to round up everyone who’s been harmed and take group legal action?

    The problems with this person running (or running into the ground) art festivals go back to at least 2006. Visit http://www.thelist.org. There are three scorching reviews from when he was operating under a different business name.

    And, it appears that the, ahem, online only Western and Wildlife Art Magazine is the reincarnation of dear, departed Wildlife Art, which is why he would be in a position to mention “the former Wildlife Art that took everyone money when the ceased operations.” in the missive above.

    What’s needed in an attorney who does class actions and who will work on contingency. Didn’t there used to be an attorney in Bozeman? who wrote a legal column for one of the art magazines. He specialized in art business issues. I think Todd Wilkenson knows him. If someone can track him down, he might provide a starting point.

    Ok, I’ve just gotten permission to post this as needed. It’s a message from the President of the Society of Animal Artists which was sent out by email to all the members today:

    ATTENTION Fellow SAA Members!

    It has recently been brought to my attention that there is an unscrupulous promoter who is targeting wildlife artists. Several of our members have complained about the lack of promotion for these shows, the failure of the promoter to provide refunds for their fees even when they cancelled months in advance, etc. Some of the artists have even said they have been threatened with legal action just because they were attempting to get refunds. So please BEWARE of promotions for shows you’ve never heard of, in locations which would probably not be great for sales even in the best of economic times. Don’t be afraid to check with your fellow artists to see if they are familiar with a promoter, or a specific show. And ask for references from artists IF you consider signing up for a show. Don’t accept just one or two references; ask for the entire list of artists who have previously participated in one of the promoter’s shows! Be very, very cautious! None of us can afford to pay large amounts for booth fees, and the costs of a hotel, etc., to participate in a show that isn’t going to be productive for us.

    Some Red Flags:
    · A large upfront payment required
    · No written refund policy for cancellations
    · Entry and booth fees, but no commission – The promoter has no “skin in the game” which could lead to little or no promotion.
    · Promoter unwilling to provide names of artists who have shown at previous shows or data on sales and attendances of previous shows
    · First time shows – Even though every show has to have a first time, check to see if the promoter has had successful shows elsewhere.

    Last year, I “signed on” by sending a check for his Jackson Hole show…then two weeks later, I ended up having to fly to VA to help my 93 year old mom. I wrote, called, etc Mr. Gervais, and he refused to return my money!!!

    The friend who told me about him, sent to the show and said NO ONE KNEW IT WAS HAPPENING!!!! AND HARDLY any one made it to the building she and the other artists were set up in!!! SO, actually, I saved gas money!!!

    HAD another friend talk 5 of her friends to go to his “show” in Tucson, same thing: NO CUSTOMERS!!!

    Had another friend who went to his “show” in Oregon…same story!!!

    THIS GUY IS NOT WORTH A POSTAGE STAMP!!!

    AND, he threatened me with almost the exact same words that I read at the top of this blog!!! Let all artists beware of this IDIOT!!!

    Susan - is the attorney you’re thinking of Art Frazier? (can’t recall specifically if that’s his first name or not). He wrote for Art of the West, and also had the same columns published in the Montana “State of the Arts” newspaper.

    BJ - thank you for sharing your experience. The more we have on here, the more artists will know what to watch out for (or the more chance this will show up on an internet search).

    I think it is a strange coincidence that ‘Troy’ also told me that if I was going to complain, than to complain about Wildlife Art mag, almost in the same words as Mr. Gervais’ email to Julie. I am convinced now that the ‘intern’ that i talked to was actually Mr. Gervais. It worries me that, as a beginning artist, as to who to trust when it comes time for me to try to find shows to sell my work at.
    I am still stunned at how big this has become!

    I posted in an earlier blog that his “greed” will be his undoing. It appears that things are now unraveling. He still has not removed my name from his list. I have checked the list of shows and not one of them is listed on the event calendar of the venue where they will take place. I note he has some very well known “headliners” - Lathams, Terry Isaac, Earl Kuhn, etc. Wonder if they are aware of his tactics. I have filed a complaint with the PA AG (Note - I am a senior citizen under PA law and you know how those complaints get attention!). The more people who complain, the more likely action will be taken. His contracts say you must cancel within 180 days (6 months) for a 100% refund or 150 days (5 months) for a 50% refund. Truth is - he does give refunds. He is living off the money he collects from these “booth fees”. There were pictures of him on the internet at a big art gala in New York City recently. Guess who paid for THAT! I would also note that David J. Wagner is on the magazine’s “Board of Advisors”. I live on social security and what I make at art shows - losing over a half a month’s social security to this guy has made things a tad difficult.

    I worked for a newspaper for 17 years and one day without warning I did not have a job. After that nothing that people do surprises me.

    I sent my 2 year renewal to Wildlife Art magazine and a few days later I heard they were no more. When I tried to contact them to get my money I got no answer.

    I have reason to believe that Dr. Wagner and some of the artists mentioned above have been or will be informed about what is going on with Gervais.

    Lori, I understand your concern about being a beginning artist and who to trust. I think you have a pool of people right here, for starters. Also, go check out the websites for the “real” shows- the Southeastern Wildlife Exposition, Natureworks, Reflections of Nature, etc. And then compare what they say, how they present the information on their shows and who is in them, to what Gervais has. The differences should be pretty obvious.

    Gervais has apparently operated in the past as Southwest Florida Art Shows, Palmetto Art Shows and Gervais Fine Art and Craft Festivals.

    I contacted the U.S. Department of Justice to see if anything could be done through them. They are the ones who nailed Ken Roth (listed on the SList). He is now serving 51 months in jail - 3 years probation and over $750K in restitution. He ultimately plead guilty to mail fraud. I will let you know if I hear from them.

    And they suggested filing a report with Ardmore, PA local Police Dept.

    Yup, I found that one too last night. A Christopher James Gervais is also listed on a stock brokerage guide site as working for Edward James. I signed up to get the report, but it had no additional information like where he was registered, who his previous employers were, all of which I found interesting in its absence.

    He seems to spend a fair amount of time co-chairing society charity bashes.

    I’m downloading/bookmarking everything I find.

    Googling his name was the first time I’ve ever tried to just see what I could find out about someone. Felt kinda weird, but it’s in a good cause. I only found one Christopher J. or James Gervais.

    Yes, the person in that facebook picture is the person who ran the show that I attended to check out for future reference. I always try to check out a show first, rather than just signing up for one blindly. He didn’t take kindly to my checking out his show and said I was trying to take money out of his pocket. That’s is how the ‘I know where your children go to school’ comment came up. That comment really rattled me and when I asked if he was making a threat, he tried to pass it off as no, he was just making a statement. There were plenty of people around, so that was enough to convince me I wasn’t dealing with someone I wanted to do business with. I never did report on the show to the online forum as I had promised. I had just planned to report # of exhibitors, type of exhibitors, attendance, etc…just the facts. After that encounter, would you have posted your findings?

    Anyway, that’s him.

    Sad to say that Mr. G has now worked his way into Canada, listing 3 shows there this year. 16 artists listed for Alberta. If he collected a minimum of $350 from each - $5600. When I spoke with him on the phone - waaaay back in 08, he was pleasant, informative, and admittedly, did like to toot his own horn. Given the comments, however, he seems to have been reduced to being nasty, evasive, and downright intimidating. Perhaps this is a sign his little scheme is beginning to unravel. If the authorities can’t/won’t take him down, we must do all we can to see that his scheme is made public so others don’t fall victim. I have posted a notice on the Artist’s Magazine forum about him and so far, over 20 NEW people who have read the post have been advised.

    It is good to see everyone looking out for each other! And helping track down
    someone who has ripped off a fellow artist. Has anyone thought about how Gervis/Marsh is operating? It’s close to being a “Madoff” a kind of an art ponzy
    scheme. Seriously, He does do a few shows but then cancels others and takes the
    money. I am sure he has been doing this longer than most people know.

    I have not fallen prey to these Troy/Chris shows only because, THANK GOD, I have a day job. Without the time to invest in fairs and shows, I’ve passed on the FL shows [and I live a few hours drives from most of Troy/Chris’s shows].

    I have just received information that an artist who was going to be a featured artist going to be pulling out of that show after finding out what is going on. Can’t say more than that, but apparently, they were offered free space and then, of course, would be used to pull in the less well known artists, who would then be cheated.

    So, there are starting to be results from everyone’s efforts already. Good job! Keep spreading the word.

    Susan - I know which “featured artist” you are talking about - I was the one who called to alert him of what was going on. We have had several discussions. And I think I rattled Mr. G’s cage. I just received a letter from him via email. It was very hostile. My name is now removed from his website - after I threatened a copyright/privacy law violation lawsuit and supposedly, I am going to get a refund (”in due course”). HA! He “expelled” me from one of his shows (Kansas City) which I was still under contract to do. He’s claiming a commission on a referral (which hasn’t yet panned out) but if I get ANY money from him, I think I will fall over in a dead faint!

    After being in the dumps (and ready to throw out my brushes and go back to being a paralegal), I received glorious news today. I won’t use Julie’s blog to tout my accomplishment - but it made my day and made me realize that the sun also rises! I am truly blessed.

    I checked his website today to check the link for the Grand Teton show which was supposed to be “live” yesterday. Page Not Found. All the names of exhibitors under that show have now been removed. The only active site is the one for the British Columbia show with Terry Isaac. Appears to be the ONE show out of all he has had “scheduled” that he may be “promoting”. Yet to be determined if any media ads are done and they actually get customers! Some of the links to images on his site are now becoming little red x’s.

    The featured artist with whom I’ve had contact has not yet heard from Mr. G. Said he would call him again if he did not hear from him.

    I wished I had found this blog about 6 months ago when I first had contact with C. Gervais. I represent Andrew Kiss and I am also his daughter. We signed up to do a show in Alberta, Canada and I will just say that things are not going well. With the information from this blog and other sources I was able to spread the word to artists in Alberta and British Columbia. I did quote a few posts I found here and also emails I have received from the organizations he claims to support. I think the most important thing is to make sure everyone is aware of what this man is doing and try our best to put a stop to it. Please contact me for further information as I apparently have a lawsuit being brought on by Mr. Gervais due to my contact with other artists. Thanks to everyone for information posted - without it there would be many artists attending a show in a high school gym or curling rink. Our artists deserve so much better than that!

    Wow, I can’t believe Christopher J. Gervais is still in action. He preys on artists! My negative experience with him goes back to 2007, here in PA. He cancelled a show at ZooAmerica in Hershey PA 11 days prior to the show. I was promised my $175 back … you know how the story goes… Emailing Mr. Gervais was futile; he threatened ME, saying I was falsifying information.

    Thankfully, ZooAmerica honored the show for me and I had a solo two-day exhibition of my wildlife art. Mr. Gervais used that against me and refused a refund. I finally filed a report with my area’s BBB (Washington DC Metro area), and took it a step further and filed a complaint with the PA Attorney General’s Office. Lo and behold, a check for $175 was “donated” to ZooAmerica by him and the Zoo promptly refunded my money to me.

    It was an awful experience. I can’t believe someone can be so unscrupulous and still continue to do “business”. I see he has branched out to the western USA and Canada. I’m finding several websites that he has set up. I’m sorry for everyone’s bad experiences but am also heartened that the word is getting out about this man’s business practices. I felt very vulnerable and shocked at how he treated me. I’m used to people being honest. Having a PO Box only address should have set off alarms for me, but since I’d read his ad in Wildlife Art Magazine, I truly thought he was on the up and up.

    I would urge everyone to take the steps I did (BBB, State Atty General’s Office). As I said, he PREYS on artists.

    I just have to add a few more comments. I have been in one of his shows and it was a lesson I’ll NEVER repeat! He’s a “SHAM” and he expects the artists to do the promotion. He’s had so called shows that never happened. This year he was selling sites for the 2nd show in Enumclaw. But he forgot to rent the space but he’s still selling spaces for the show. Which just happens to be at a different site and town that does not know that there is suppose to be a Wildlife Art Show at their site.

    He’s still at it and going strong! I really have to wonder what some of these well known artists are allowing him to use their names for his shows. I do know that he’s had a photo of me and my work on his site, which he took at one of the shows and I’ve asked him to remove it. He did write me to tell me he has done this but that I had given him the rights to show it [which I had not]. And that he is very sorry I’m displeased with his show. But I checked his site and I’m still there, so what can I say.

    I’ve had several calls from Florida, Arizona, Washigton, Canada and many e-mails about him and I tell the artists who call to stay away from him and if they have sent their funds they will not get them back. Plus please “call the exibit site” to see if there is anything going on and that he has a habit of cancelling 2 weeks before the show is to happen.

    Just wanted to let you know that the show in Red Deer this past weekend was a complete waste of time. We did not attend so I cannot give exact details. Six artists did show up and approx. 10 customers. I hope artists for the upcoming Vancouver show are aware of what they are getting themselves into.
    A simple solution to stop this from happening is to warn as many artists so they don’t send him money in the first place. No artists.. no shows.
    If anyone needs help in getting their images removed from his website please email me for information. I was able to have a page with Andrew’s image suspended. A big thank you to all the supporters that have either emailed or called me!

    Perhaps the Alberta/Red Deer artists have friends who are signed up for the Vancouver show and will give them the heads up. He is notorious for not advertising his shows (believing it is the artists responsibility). He shirt-tails on other major events (i.e. Grand Teton show during Jackson Hole Fall Arts Festival) but his “venue” is far removed from the events in town - and he will not advertise. On Dec. 15 I sent him this message about the Jan 09 Tucson show: “Is there any info available yet on the January show in Tucson AZ? I note the 37th Annual Tucson Indian Arts and Crafts Show is the same weekend at the Convention Center. Are we a part of that show?” His response was: “I am still trying to recruit additional artists for the show. Participation has been light due to the slow economy. The Indian Art Show has been running for a long time and is a separate event. It is my hope to attract buyers from their show to ours.”
    This is how he operates. After repeated attempts to get more info, he FINALLY emailed me on Dec 28 (two weeks before the show) to say the show was canceled and promised a refund - which I have yet to receive. He “expelled” me from his Kansas City Show for being “hostile and irrational” (because I demanded specific information about the show - i.e. advertising, #artists attending, set-up, etc). I withdrew from Grand Teton because of what I learned about him and his shows. He now owes me $750. And I filed a complaint with the PA Attorney General and several other agencies. I post this information here so that others might be made aware of his unethical business practices.

    Well I wish I knew about this ordeal a few months ago as I also signed up for the Grand Teton Art show. I emailed Mr. G and asked him (right after he cashed my check) how come the show is not listed on the Fall Arts Festival website, adds and brochures nor is it listed as an event at the Snow King resort? He said that we would be listed in the program book and that it is too early with our small sponsership to be listed on their sites. Last week I found out about this nightmare of Wildlife Art Shows and contacted the Snow King Resort to see what I could find out. They said that Mr. Gervais reservations had been cancelled due to non-payment by the deadline. The artists listed earlier last week dropped from 16 to 9 overnight and I emailed Mr. G and stated these issues and requested a refund for a show that is disolving very quickly and should be cancelled. No response as of today. Can you please have Martisiq contact me?

    Short version….
    Last year I signed up for Santa Fe & Jackson Hole Western & Wildlife Art Shows with Mr. Gervais. These where the first shows I ever tried to participate in.

    The Santa Fe show did not happen and I was promised a refund. I did attend the show in Jackson but it was falsely and inadequately promoted. At the end of the show I asked for my refund for the Santa Fe show, but he didn’t have his checkbook and would send it to me in the mail.

    I’ve emailed and called many, many times. When he did answer the phone he pretended to be Mr. Gervais’s assistant.

    I know I will never get a refund and I’ve learned my lesson.

    I found this website after doing a Google search for Gervais. I was contacted this morning by the PA District Attorney’s Office regarding a complaint I filed back in 2006 against Gervais. So I decided to see if he was still in business, when I was dealing with him it was Gervais Art Festivals. I paid $175 for booth space at a fair here in No. California, it was a first time show so I was tentative but needed some income. Sent in the app and check, red flag should have been there was very little info on the app about details of the show, i.e., location, set up, times, etc. I heard nothing from him or his staff by email, mail or phone. 2 weeks before the show I emailed for details about set up, booth space and a reply came back that the show had been cancelled. Long and short of it, I repeatedly called and emailed asking when my refund would be coming and heard nothing. 3 months later I finally demanded a reply and said I would take this to my attorney if I didn’t hear. Well that got them going and a lady in his office emailed back and said I would get it when they could afford it, and if I didn’t like that it was too bad. She also stated it’s artists like me that don’t have a clue about how things work in the world that make her job so difficult. She lied and said her staff had contacted me several times by phone (NEVER!) and called me a liar. Next I emailed Gervais directly to let him know his staff needed some serious customer service training and when would I get my refund back. His response was way over the top rude, arrogant, he called me names and said I was a liar, said he was teaching me a lesson on being patient. I filed a complaint with the PA BBB, noting that there were several other complaints at the time. I then filed a complaint with the PA Attorney General’s Office. Gervais did not respond to their letters. I wrote a Letter to the Editor to the local PA newspaper warning people not to deal with this company. I considered the case closed until I got the call this morning from the AG’s Office, maybe enough people have filed complaints against Gervais that they are going to go after him! Thanks for this Blog, great way to get the word out.
